The loyalty program for East Coast Sirens Planters & Gifts (the “Company”) is Sirens’ Booty.
The Sirens' Booty operates under the terms and conditions as set out below unless otherwise expressly stated (the “Program Rules”).
The Program Rules govern the Company’s relationship with members of the Sirens' Booty (collectively, “Sirens' Booty Members,” and individually, a “Sirens' Booty Member,” “Member,” or “you”), including how Members manage their accounts, earn and redeem Sirens' Booty points (“Points”).
By opening a Sirens' Booty membership account (“Account” or “Membership Account”), or by using the Membership Account number you were assigned (“Membership Number”) to receive and redeem benefits of the Sirens' Booty, including, without limitation, Sirens' Booty Points, you agree that:
- you consent to the collection, use, and disclosure of your personal data by the Company, the Sirens' Booty, Participating Properties and Partner Programs.
All Sirens' Booty benefits, amenities, offers, awards and services are subject to availability and may be changed by the Company at any time without notice. The Company may terminate the Sirens' Booty, in whole or in part, with six (6) months' advance notice to all active Sirens' Booty Members and with less than six months' notice in any jurisdiction if required to do so by applicable law. At the Company’s sole discretion, the Company may choose to substitute a similar Sirens' Booty for the Sirens' Booty at any time immediately upon notice to active Loyalty Members. If the Sirens' Booty is terminated, all unredeemed Points will be forfeited without any obligation or liability, and no Redemption Award claims or promotional Award claims will be honoured after the conclusion of the notice period.
These Program Rules supersede all previous terms and conditions applicable to the Sirens' Booty. Except as otherwise expressly prohibited or limited by applicable laws, Company may at any time amend, modify or supplement these Program Rules, the structure for earning awards (“Awards,” and individually, an "Award") and Award levels at any time, with or without notice, even though such changes may affect the value of Points or Miles, or the ability to obtain certain Awards (collectively “Program Rules Changes”). Loyalty Members are responsible for remaining knowledgeable of the Program Rules and any Program Rule Changes. Your continued participation in the Sirens' Booty will constitute your acceptance of any such Program Rule Changes.
1. JOIN THE SIRENS' BOOTY
Membership in the Sirens' Booty is free and available to any individual who: (a) possesses the legal authority to agree to the Program Rules; (b) resides in a jurisdiction which legally permits participation in the Sirens' Booty; (c) provides valid and accurate personal information when enrolling in the Sirens' Booty; (e) is not already a member of the Sirens' Booty (i.e., does not already have a Membership Account); and (f) has not previously been terminated from the Sirens' Booty.
1.1.a. Members are responsible for reading and understanding the Sirens' Booty Rules, Account statements, and other communications from the Company about the Sirens' Booty in order to understand his/her rights, responsibilities, and status in the Sirens' Booty. If a Member has any questions about the Sirens' Booty or these Program Rules, the Member should contact [email protected]
1.1.b. Members are responsible for reading the Company’s General Terms & Conditions in order to understand how the Company collects, uses, and discloses a Member’s data. If a Member has any questions about the Company’s Privacy Statement or its collection, use, or disclosure of a Member’s data, the Member should contact [email protected]
1.2 Benefits of Membership
1.2.a. Member Support. Sirens' Booty Members will have access to award redemption requests on the Member’s Account.
1.2 b. Points Earned Locations. Sirens' Booty Members are eligible to earn reward points on purchases made at:
- i) the website eastcoastsirens.com;
- ii) the store located at 1407 Lighthouse Road, Digby, NS; and/or
iii)any market or location that East Coast Sirens Planters & Gifts is set up to sell.
1.2. c. Point System: For every One Dollar ($1.00), prior to taxes and shipping costs (both of which are excluded from the Sirens' Booty point accumulation system), spent by a new or existing Sirens' Booty Member, that Member shall receive 10 points. The points shall be recorded electronically against the Members’ account. The Member is able to check on their points by accessing their Member Account on the East Coast Sirens Planters & Gifts website.
1.2. d. Points Redeemed. Points may be redeemed by a Sirens' Booty Member who has achieved the various redeemable steps:
150 points = $1.00 savings/discount
1000 points = $5.00 savings/discount
1500 points = $10.00 savings/discount
3000 points = $20.00 savings/discount
Points may be accumulated to take advantage of larger savings at the time of purchase.
1.2. e. Notification. Sirens' Booty Members may receive periodic notices by way of email or text messages to update the Sirens' Booty Members of their point balance.
1.2. f. VIP Rewards. Members who have cumulatively spent enough at any of the East Coast Sirens Planters & Gifts locations (as noted in 1.3c) to earn 25000 points, will automatically begin receiving 1.5 times the value in points with each One Dollar ($1.00) spent.
1.2. g. New Customer Incentive. For each new member who joins the Sirens' Booty after and including July 7, 2021, they will receive an automatic 500 points in their account.
1.2. h. Anniversary Gift Incentive. When a Sirens' Booty Member is active with the program for a period of twelve months, they will be eligible to receive a key chain (crafted by East Coast Sirens Planters & Gifts) of their choice at a maximum value of Ten Dollars ($10.00). Shipping costs, if necessary, will be an extra charge. The key chain may be included with any order that is being sent to the Sirens' Booty Member upon achieving eligibility status.
1.3 Conditions of Enrollment
1.3.a. Completing the Enrollment Application. An individual may apply to enroll in the Sirens' Booty by fully and accurately signing up as a registered user at the East Coast Sirens Planters & Gifts website, at a Participating Property, or through another enrollment channel. The Company may deny membership in the Sirens' Booty to any applicant in its sole discretion and without written notice.
1.3.b. Individual Membership. Only individuals are eligible for Sirens' Booty membership, and each individual may maintain only one Membership Account. All Loyalty Member accounts are individual accounts and no joint accounts are permitted. Sirens' Booty benefits are non-transferable unless expressly stated otherwise.
1.3.d. Assignment of Membership Account and Membership Number. After applying to the Sirens' Booty, a Membership Account will be opened and a Membership Number will be assigned to each applicant. Upon receiving this Membership Number, an individual becomes a Member eligible to earn Points.
1.3.e. Duplicate Accounts. An individual may join the Sirens' Booty. However, a Member may not have one or more duplicate Accounts under the Sirens' Booty at any time.
- If more than one Sirens' Booty Membership Number is assigned to an individual for the Sirens' Booty, he/she will only receive Points or Miles for one Membership Account. Duplicate Membership Accounts may be cancelled.
- A Member with individual Membership Accounts in the Sirens' Booty will not be able to link these Accounts, or transfer points across Accounts. The Member must combine them into a single Membership Account with one number and one Points balance.
1.3.f. Personal Profile. Information provided by a Member will be maintained in a personal preference profile with the Membership Account. All information provided by a Member in his/her personal profile must be valid and accurate and must be kept current.
- A Member may change his/her address by changing his/her information on the Account Profile on the Sirens' Booty website.
- Credit card information included in a Member’s profile will be solely used by East Coast Sirens Planters & Gifts. A Member may change his/her credit card authorization for future transactions by changing his/her information in the Account Profile on the Sirens' Booty website. A Member must notify the Company if the authorized credit card is lost, stolen, invalidated or expired.
1.3.g. Use of Information Collected in Application. The information a Member provides to the Company when completing the Sirens' Booty application and redeeming Points is processed in accordance with the Company’s Privacy Statement. Communication of relevant information is important to administering the Sirens' Booty and providing each Member with the opportunity to maximize the benefits of Membership.
1.4 Transfer of Points
1.4.a. Conditions for Transferring Points and Miles. Accrued Points and Miles do not constitute property of the Member. Points accrued by a Sirens' Booty Member are for the Member’s benefit only and may not be transferred to anyone except as provided below.
- Transferring Points to Accounts of Family or Friends. There is a limited exception to the restriction on the transfer of a Member’s Points to the accounts of friends or family, provided both Accounts are in good standing. See Section 2.8 for more information.
- Death. In the event of a Member’s death, the Company may, in its sole discretion, allow unredeemed Points from the deceased Member’s Account to be transferred to a family member or a friend who is an active Member upon the Company’s receipt and review of all requested documentation and communications.
- Divorce. In the event of a Member’s adjudicated divorce settlement, the Company may, in its sole discretion, allow unredeemed Points to be transferred from one Member’s Account to another Member’s Account upon the Company’s receipt and review of all requested documentation and communications including, without limitation, legal documents directing such a transfer of Points.
- Members are prohibited from bartering or selling Points for cash or other consideration.
- Any Points which the Sirens' Booty deems in its sole discretion to have been transferred in violation of the Sirens' Booty Terms and Conditions may be confiscated.
1.4.b. Points Expiration Policy. Members must remain active in the Sirens' Booty to retain Points they accumulate. If a Member Account is inactive for ten (10) consecutive months, that Member Account will forfeit all accumulated Points. Members can remain active in the Sirens' Booty and retain accumulated Points by earning Points in the Sirens' Booty or redeeming Points in the Sirens' Booty at least once every ten (10) months, subject to the exceptions described below. Once Points are forfeited, the Points cannot be reinstated, but a Member can earn new Points unless that Member’s Account has been deactivated.
- Not all Points activities help maintain active status in the Sirens' Booty. Examples of activities that do not count toward maintaining an active status in the Sirens' Booty include, but are not limited to:
- Gifting or transferring Points; however, converting Points to Miles or Miles to Points does count toward maintaining an active status;
- Receiving Points as a gift or transfer
- Awards redeemed by a Member prior to Point forfeiture are still valid even though the Award may not yet have been fulfilled at the time of Point forfeiture.
1.5 Changes to the Sirens' Booty
1.5.a. Modification of Program. Except as otherwise expressly prohibited or limited by applicable laws, the Company has the right to change, limit, modify or cancel the Loyalty Program Rules, Awards and Award levels at any time, with or without notice, even though such changes may affect the value of Points, or the ability to obtain certain Awards. The Company may, among other things: (i) increase or decrease the number of Points required for an Award; (ii) withdraw, limit, modify or cancel any Award; (iii) add blackout dates, for any Award or otherwise restrict the continued availability of Awards; (iv) change program benefits, conditions of participation, rules for earning, redeeming, retaining or forfeiting Points, or rules governing the use of Awards. In accumulating Points Members may not rely upon the continued availability of any Award or Award level and category.
1.5.b. Termination of Program. The Company may terminate the Loyalty Program with six (6) months' advance notice to all active Loyalty Members. At the Company’s sole discretion, the Company may choose to substitute a similar loyalty program for the Loyalty Program at any time immediately upon notice to active Loyalty Members. A Member may not accumulate Points or claim Redemption Awards, promotional Awards or Loyalty Program benefits or amenities after the termination of the Loyalty Program. If the Loyalty Program is terminated, all unredeemed Points will be forfeited without any obligation or liability, and no Redemption Award claims or promotional Award claims will be honoured after the conclusion of the notice period. The Company may terminate any of the Loyalty Program in whole or in part, in any jurisdiction on less than six months' notice if required to do so by applicable law.
1.5.c. Benefits Subject to Availability and Modification. All Loyalty Program benefits, amenities, offers, awards and services are subject to availability and may be changed at any time without notice.
1.5.d. Eligibility to Receive Benefits. By accepting any Loyalty Program benefits, amenities, offers, awards or services, including, without limitation, any Points, Redemption Awards and promotional Awards, a Member acknowledges that he/she is responsible for determining whether he/she is eligible to receive and that he/she is eligible to receive, such Loyalty Program benefits, amenities, offers, awards or services (including, without limitation, Points, Redemption Awards and promotional Awards) under applicable laws, gift policies and incentive policies. Each Member must immediately notify the Company if he/she is not eligible to receive any Loyalty Program benefits, amenities, offers, awards or services at any time.
1.5.e. Eligibility Notification. A Member must promptly notify the Company in the event that (i) he/she is not eligible for any reason, including, without limitation, pursuant to any applicable laws, gift policies or incentive policies, to earn Points or any other benefits that a Member may earn under the Loyalty Program, or (ii) his/her Member Account has been credited with any Points or any other benefit that a Member may earn under the Loyalty Program that he/she has not earned or is not eligible to earn.
1.5.f. No Sale or Transfer. Points, Redemption Awards, promotional Awards and other Member benefits may not be sold, bartered or transferred (other than by the Company or its agents). Any attempted transfer, sale or barter will be void and will be confiscated. The Company and its partners may refuse to honour or recognize any Points, Redemption Awards, promotional Awards or Member benefits which the Company believes may have been transferred, sold or bartered.
2. Transferring Points from One Account to Another
2.1.a. In accordance with the conditions for transferring Points as described in Section 1.4.c. a Member can transfer up to a maximum of 5,000 Points per calendar year to another Membership Account as long as both accounts are in good standing. A Member can receive up to a maximum of 5,000 Points per calendar year from other Membership Accounts as long as the Accounts are in good standing.
2.1.b. Authorization to transfer Points must be initiated by the Account holder with the Points to be transferred by contacting [email protected]. The Account holder requesting the transfer must provide the Membership Number of the Points recipient at the time of the Point transfer request.
2.1.c. Once the authorization for transfer is received and processed, the transferor relinquishes all rights to the transferred Points, and they become the recipient’s Points.
